Welcome to Filini. "We", "us" and "our" mean Filini FlexCo, a company registered in Austria (Firmenbuchnummer FN 678205 k). We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). Filini is powered by Shopify, which enables us to provide the Services to you. By visiting, interacting with or using our Services, you agree to these Terms of Service and to our Privacy Policy.
Nothing in these Terms affects your statutory rights as a consumer under Austrian or EU law, and where these Terms and those rights disagree, those rights win.
1. Access and account
By agreeing to these Terms you confirm that you are at least the age of majority in your country of residence. To use the Services you may be asked for information such as your email address and your billing, payment and shipping details. You confirm that everything you give us is correct, current and complete, and you are responsible for keeping your account credentials secure.
2. Our products
We have made every effort to represent our products accurately. Colours and appearance can still differ from what you see, because screens vary. We cannot guarantee that a product will look identical to its depiction in our store, and we may discontinue any product at any time. This does not affect your statutory rights if a product is faulty or not as described.
3. Orders
When you place an order you are making an offer to buy. We may accept or decline it. Your order is accepted once we confirm acceptance and process your payment. Please check your order carefully before you submit it.
4. Prices and billing
All prices are shown in EUR and include VAT where it applies under Austrian and EU law. Prices can change without notice. The price you pay is the one in effect when you place your order, as set out in your order confirmation email. For customers outside the EU (United Kingdom, Switzerland, Norway, Iceland) local taxes or import duties may be charged on delivery and are the customer's responsibility.
5. Shipping and delivery
All orders are fulfilled from our hub in Bregenz, Austria. Delivery times are estimates rather than guarantees, and we are not liable for delays caused by carriers, customs processing or other events outside our control. For consumers, risk of loss or damage passes to you when you or someone you have nominated takes physical possession of the goods.
6. Intellectual property
Everything on our Services, including trademarks, text, images, graphics and design, belongs to Filini or its licensors and is protected by intellectual property law. Please do not reproduce, distribute or create derivative works from it without our written consent.
7. Optional tools
We may give you access to third-party tools "as is", without warranties of any kind. Any use of optional third-party tools is at your own risk.
8. Third-party links
Our Services may link to third-party websites. We are not responsible for the content, accuracy or practices of those sites.
9. Relationship with Shopify
Filini is powered by Shopify, which enables us to provide the Services to you. Any sale or purchase you make is made directly with Filini. Shopify is not responsible for any aspect of the sale between you and us.
10. Privacy
All personal information we collect is handled in line with our Privacy Policy. By using the Services you confirm that you have read it.
11. Feedback
If you send us feedback, suggestions or reviews, you grant us a perpetual, royalty-free licence to use, reproduce and publish that content for any purpose connected with running and improving our Services.
12. Errors and omissions
We may correct errors, inaccuracies or omissions and update information at any time without prior notice. If an obvious pricing error means we cannot accept your order, we will tell you and refund you in full.
13. Prohibited uses
Use our Services only for lawful purposes. Do not use them to break the law, infringe intellectual property rights, transmit harmful code, or interfere with anyone else's use of the Services.
14. Termination
We may end your access to the Services if you breach these Terms. The sections covering intellectual property, limitation of liability, indemnification and governing law continue to apply afterwards.
15. Disclaimer of warranties
The Services are provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. This does not limit the statutory guarantee rights (Gewährleistung) you have as a consumer when a product is faulty or not as described.
16. Limitation of liability
To the fullest extent permitted by law, Filini and its partners, directors, employees and affiliates are not liable for indirect, incidental, punitive or consequential damages arising from your use of the Services. Nothing here limits our liability for death or personal injury, for intent or gross negligence, or for anything else that cannot be limited under Austrian law.
17. Indemnification
To the extent permitted by law, you agree to hold Filini, Shopify and their affiliates harmless from losses, damages or claims arising from your breach of these Terms or your violation of any law or third-party right.
18. Severability
If any provision of these Terms turns out to be unlawful or unenforceable, the rest stay in full effect.
19. Governing law
These Terms are governed by Austrian law. If you are a consumer resident in the EU, you keep the protection of the mandatory consumer law of your own country, and you may bring proceedings in the courts there or in Austria. We will bring any claim against a consumer in the courts of their country of residence. For everyone else, the courts of Bregenz, Austria have exclusive jurisdiction.
20. Changes to these Terms
We may update these Terms at any time. Material changes will be notified in line with applicable law. The version in force when you place an order is the one that applies to that order.
